§ 1. General provisions.
1. The buyvapo.eu online store conducts retail and wholesale sales via the Internet. The possibility of placing orders and making purchases is available both via the website and by phone.
2. All goods offered in the buyvapo.eu store are brand new, free from physical and legal defects. All goods have been placed on the market in accordance with the law in force in Poland and in the European Union.
3. All prices on the buyvapo.eu website are gross prices and are given in Polish zlotys. Product prices do not include the cost of delivering the goods to the Customer. VAT invoices are issued at the Customer's request.
§ 2. Purchases and execution of orders.
1. Placing an order is done by completing the form containing the necessary personal data necessary to verify the order and its implementation. You can place an order by registering on the store's website.
2. Making purchases via buyvapo.eu requires the acceptance of cookies by the user's browser.
3. Payment methods - the Customer may choose the following payment methods for the ordered Goods:
- by bank transfer directly to your account
- imoje (BLIK payments, payment card, electronic transfer via the external imoje payment system, operated by ING Bank Śląski S.A. with its registered office in Katowice.)
4. After placing the order, the Customer will receive an e-mail confirming the acceptance of the order.
5. Shipment of goods is carried out within 3 business days after the payment is credited to the account of buyvapo.eu. In exceptional cases, the shipment of goods may be delayed.
6. The goods are shipped via the following carriers:
- Express - by InPost courier, this company usually delivers the goods within 24 and a maximum of 48 hours.
- Ordinary - by InPost, who deliver the goods within 24 and a maximum of 48 hours.
- Ordinary - Priority Polish Post which delivers within 2-3 working days.
§ 3. Warranty and complaints.
1. All products offered on the buyvapo.eu website are covered by the manufacturer's, importer's or Seller's warranty, which is valid in Poland.
2. Due to the exploitation nature of some of the goods sold or their parts, we provide a shortened warranty for the batteries contained in them. This is 3 months from the date of purchase
3. In exercising the rights under the warranty, the customer is obliged to deliver the damaged goods to the following address:

4. We recommend adding proof of purchase or warranty card or order number and a description of the damage and contact details.
5. The buyvapo.eu service will consider a properly reported product complaint in the shortest possible time, which may not exceed 14 days from the date of receipt of the product for inspection. If the complaint is accepted, the Ordering Party is sent a new copy to the place that is inconsistent with the order. In the event that the complaint is not accepted, buyvapo.eu returns the advertised goods.
6. If it is not possible to replace or repair the defective goods, the Seller informs the Ordering Party by e-mail or by phone. At the Customer's choice - the amount paid is returned to his bank account, or another product is sent at the same price, selected by the Customer. The costs of the return shipment to the customer are borne by the Seller.
7. Pursuant to Art. 558 § 1 of the Civil Code, the Seller's liability under the warranty for the Product towards the Customer who is not a consumer is excluded.
§ 4. Returns of goods.
1. Pursuant to the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (Journal of Laws No. 22, item 271) Art. 2 point 2 within 14 calendar days from delivery of the ordered goods, the consumer has the right to return them without giving reasons as part of withdrawing from the contract, according to the general rules resulting from the provisions on concluding distance contracts. To keep the 14-day deadline, it is enough to send a statement before its expiry.
If you want to use the above-mentioned right of return, the goods should be sent back at your own expense by registered mail, parcel post, courier or to an inpost parcel locker to the following address:

2. If the right referred to in point 1 of this paragraph is exercised, the Ordering Party - consumer is obliged to return the delivered order unchanged, unless the change was necessary as part of the ordinary management of the item sold, and buyvapo.eu returns the amount due to the bank account of the Ordering Party - consumer for the returned order up to 14 days from the date of receipt of the product return. If the product or packaging shows signs of use, the refund amount will be reduced by the costs of bringing the product and packaging to a condition comparable to new.
3. The provisions regarding the consumer contained in this paragraph 4 of the Regulations shall apply from January 1, 2021 and for contracts also concluded with a Customer who is a natural person concluding a contract directly related to its business activity, when the content of this contract shows that it does not have it is of a professional nature for that person, resulting in particular from the subject of business activity performed by him, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
§ 5. PROVISIONS CONCERNING ENTREPRENEURS
1. Paragraph 5 of the Regulations and all provisions contained therein are addressed to and thus bind only the Customer who is not a consumer, and from January 1, 2021 also natural persons concluding a contract directly related to its business activity, when the content of this contract shows that it does not have a professional nature for this person, resulting in particular from the subject of the business activity performed by him, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
2. The Customer has the right to withdraw from the Sales Agreement within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may take place without giving any reason.
3. The Seller's liability towards the Customer, regardless of its legal basis, is limited - both as part of a single claim, as well as for all claims in total - up to the price paid and delivery costs under the Sales Agreement, but not more than one thousand zlotys. The amount limit referred to in the previous sentence applies to all claims made by the Service Recipient/Customer against the Service Provider/Seller, including in the case of failure to conclude a Sales Agreement or not related to the Sales Agreement. The Service Provider/Seller is liable to the Service Recipient/Customer only for typical damage foreseeable at the time of concluding the contract and is not liable for lost profits. The seller is also not responsible for delays in the shipment.
4. Any disputes arising between the Seller and the Customer shall be submitted to the court having jurisdiction over the seat of the Seller/Service Provider.
§ 6. TERMS OF PURCHASE WITH DEFERRED PAYMENT TWISTO
INFORMATION OF THE PERSONAL DATA ADMINISTRATOR PREPARED ON THE BASIS OF ART. 13 SEC. 1 and 2 of the General Data Protection Regulation (GDPR)
In connection with the entry into force and the need to apply Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 /WE (General Data Protection Regulation) (hereinafter referred to as the "Regulation"), the owner of the Internet domain provides the following information regarding the rules for processing your personal data.
1. The website processes your personal data for the following purposes:
a) to perform the services offered on the website,
b) transferring your personal data to ING Bank Śląski S.A. ("Bank") in connection with
provision by the Bank to the Online Store of the service of providing access to infrastructure for handling payments via the Internet (legal basis: Article 6(1)(f) of the Regulation).
handling and settling by the Bank of payments made by customers of the Online Store via the Internet using payment instruments (legal basis: Article 6(1)(f) of the Regulation).
in order for the Bank to verify the proper performance of contracts concluded with the Online Store, in particular to ensure the protection of payers' interests in connection with their complaints (legal basis: Article 6(1)(f) of the Regulation).
c) transferring your personal data to Twisto Polska sp. z o.o. in connection with the possibility of proposing payment for the purchased goods or services by Twisto Polska sp. z o.o. under the contract of mandate covering the purchase formula "Buy with Twisto" and making this purchase formula available through the Online Store, as well as for the purpose of verification by Twisto Polska Sp. z o. o. will perform properly
conclusion of such mandate contracts (legal basis: Article 6(1)(f) of the Regulation).
2. In connection with the processing of personal data for the purposes set out in paragraph 2, your personal data may be made available by the Online Store to other recipients or categories of recipients of personal data, which may be:
a)ING Bank Śląski S.A.
b) Twisto Polska sp. z o.o.
3. If you provide your personal data in order to transfer your personal data to Twisto Polska sp. z o.o. before concluding a contract for the sale of goods (or services) purchased in the Online Store, the provision of this data is a condition for concluding a sales contract in connection with the business model adopted by the Online Store.
4. If you provide your personal data to the Bank in connection with the handling and settlement of payments made by you to the Online Store via the Internet using payment instruments, providing data is required in order to make the payment and provide confirmation of its execution by Bank for the Online Store.
5. If you provide your personal data to the Bank for verification by the Bank of the proper performance of contracts concluded with the Online Store, in particular to ensure the protection of payers' interests in connection with their complaints, providing this data is required to enable the performance of the contract concluded between online store and the bank.
6. In the case of transferring your personal data to Twisto Polska sp. z o.o. in connection with the possibility of offering you to pay the price for the goods or services purchased by you by Twisto Polska sp. z o.o. under the contract of mandate covering the purchase formula "Buy with Twisto" and making this formula available by the Online Store, providing this data and processing it for this purpose is required in connection with the business model adopted by the Online Store and in order to perform the contract concluded between the Online Store and Twisto Polska Sp. z o. o.
§ 7. Final provisions.
1. Personal data placed in the store's database are processed only for its needs, they are not and will not be made available to other entities. These data are collected with due diligence and properly protected against access by unauthorized persons, in accordance with the Act of August 29, 1997 on the protection of personal data (Journal of Laws of 1997, No. 133, item 883). The customer has the right to inspect their data, to correct them and to demand that they cease to be used.
